Terms of Service

Welcome to ArthWater. By accessing or using our websites, the ArthOS platform, and any related services (collectively, the "Services"), you agree to comply with and be bound by these Terms of Service ("Terms").

1. Eligibility & Accounts

By using our Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Allowed Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes, strictly in accordance with these Terms.

3. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Reverse Engineering: Decompiling, disassembling, or attempting to derive the source code or algorithms of the platform.
  • Misuse of Data: Using data from the platform for any unauthorized purpose or in violation of privacy laws.
  • Scraping: Using automated systems to access or scrape data from the Services.
  • Hacking: Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
  • Abuse: Using the Services in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Services.

4. Intellectual Property

The Services and their original content, features, and functionality are and will remain the exclusive property of ArthWater and its licensors. This includes:

  • Software: The underlying code and platform architecture.
  • UI/UX: The design, layout, look, and feel of the interface.
  • Algorithms: The proprietary reasoning engines, including ArthFlow, ArthSim, and Spectrum logic.
  • Brand: The ArthWater name, logo, and all related names, logos, product and service names, designs, and slogans.

5. Payments & Subscriptions

If you purchase any services that we offer for a fee, you agree to pay the applicable fees and taxes.

  • Billing: You authorize us to charge your chosen payment method for the Service.
  • Cancellation: You may cancel your subscription at any time, but you will not receive a refund for any partial subscription period strictly in accordance with these Terms.
  • Refunds: All fees are non-refundable unless otherwise explicitly stated in writing by ArthWater.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTHWATER SHALL NOT BE LIABLE FOR:

  • Business Losses: Loss of profits, revenue, or data.
  • Incorrect Decisions: Damages resulting from decisions made based on the platform's outputs (the platform is a decision-support tool, not a substitute for professional engineering judgment).
  • System Downtime: Interruptions or downtime caused by factors beyond our reasonable control.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
